Terms and Conditions

1. Overview

Send N Share™ provides a digital platform designed to help connect people, businesses, services and opportunities worldwide. The Services may include, without limitation:

• the Send N Share™ global search directory;
• map-based business search and discovery tools;
• free business listings and upgraded membership listings;
• Silver, Gold, Platinum or other paid membership packages;
• mobile website accounts and dashboard access;
• tools to create and manage mobile websites, products, services, promotions and portfolio items;
• advertising placements, banners, sponsored listings and promotional positions;
• advertising reports, performance reports and account summaries;
• partner, reseller or trade account services; and
• support, billing, account management and related services.

Some Services may be free, while others may require payment, approval, verification, subscription, membership, advertising booking or separate agreement.

2. Definitions

• Send N Share™, we, our or us means Wildfox Services Group Pty Ltd trading under or operating the Send N Share™ brand.
• User, you or your means any person, business, advertiser, member, account holder, partner, reseller or visitor using the Services.
• Listing means a business, trade, service, professional, opportunity or other directory entry submitted to or displayed on Send N Share™.
• Membership means a paid or upgraded Send N Share™ plan, including Silver, Gold, Platinum or other available plans.
• Mobile Website means a website, mini-site, landing page, mobile business profile or related digital page created, hosted or managed through the Send N Share™ dashboard.
• Advertising means banners, sponsored placements, map advertising, directory advertising, promoted content or other paid promotional services.
• Reports means advertising reports, campaign summaries, listing reports, traffic summaries, account reports or other analytics made available through Send N Share™.
• Content means text, logos, images, videos, business information, links, products, services, prices, promotions, contact details or other material supplied by you.

3. Eligibility

To use the Services, you must be at least 18 years old or otherwise have authority to enter into these Terms on behalf of yourself, your business, organisation or client.

If you register, purchase, advertise or submit Content on behalf of a business, client or organisation, you confirm that you have authority to act for that business, client or organisation.

4. Accounts and Dashboard Access

4.1 Account registration

To access certain Services, including mobile website creation, business or trade accounts, paid memberships, advertising reports or dashboard features, you may need to register an account and provide accurate, complete and current business information.

4.2 Account responsibility

You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account. You must notify us promptly if you suspect unauthorised access or misuse.

4.3 Dashboard use

Account holders may be provided access to a dashboard where they can create, update and manage mobile websites, business listings, products, services, promotions, portfolio items, advertising details, reports or other available features.

5. Search Directory, Map Search and Free Listings

The Send N Share™ search directory and map search are designed to help users discover businesses, services, professionals, trades, opportunities and related information.

Send N Share™ may allow users to create or claim free business listings. Free listings may be subject to approval, review, category availability, moderation, verification, technical limits and platform rules.

We may approve, reject, edit, moderate, suspend or remove listings where we reasonably believe the listing is inaccurate, misleading, duplicate, offensive, unlawful, unsafe, spam-like, inactive, harmful to users, harmful to the platform or in breach of these Terms.

6. Memberships and Paid Upgrades

Send N Share™ may offer paid memberships, including Silver, Gold, Platinum or other plans. Membership benefits may vary and may include enhanced listing features, promotional benefits, mobile website inclusions, advertising benefits, support inclusions or other available services.

Current membership inclusions, prices, limits and benefits are described on the relevant membership page, invoice, checkout page, dashboard, proposal or written agreement. We may update plans, inclusions and pricing from time to time.

Paid memberships may improve access to certain features or promotional opportunities; however, paid membership does not guarantee enquiries, sales, clicks, traffic, search ranking, customer engagement or business performance.

7. Mobile Websites and Website Dashboard

Send N Share™ may provide dashboard access for users to create and manage their own mobile websites. Each mobile website may include business details, products, services, promotions, portfolio items, links, contact information, images, videos and other approved Content.

You are responsible for the Content you add to your mobile website. You must ensure your mobile website is accurate, lawful, not misleading, does not infringe third-party rights and complies with all applicable laws, regulations and platform rules.

Each plan may include limits on the number of mobile websites, pages, products, services, promotions, images, storage, features, support, design work or other inclusions. Additional items or custom work beyond plan limits may incur extra charges.

We aim to keep mobile websites and platform services available; however, we do not guarantee uninterrupted, error-free or continuous availability.

8. Products, Services, Promotions and User Content

You are responsible for all products, services, offers, prices, promotions, descriptions, images, links and claims displayed in your listing, mobile website, advertisement or account.

You must not submit Content that is false, misleading, deceptive, outdated, unlawful, offensive, harmful, infringing, unsafe or likely to damage the reputation of Send N Share™ or other users.

By submitting Content to Send N Share™, you confirm that you own the Content or have permission to use it. You grant Send N Share™ a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, resize, adapt, publish, promote and distribute your Content as reasonably required to provide and improve the Services.

9. Advertising Services

Send N Share™ may offer advertising services, including banner advertising, map advertising, directory advertising, sponsored placements, promotional cards, rotating ads, feature positions, campaign packages and other advertising options.

All advertising is subject to review and approval. We may refuse, remove, pause or request changes to advertising that we consider unsuitable, misleading, offensive, unlawful, unsafe, infringing, technically incompatible or inconsistent with Send N Share™ brand or platform standards.

Advertising positions may rotate, vary by device, vary by page, change over time or depend on availability, unless a fixed position is expressly confirmed in writing.

Advertising services are promotional services only. We do not guarantee clicks, impressions, enquiries, conversions, sales, ranking, traffic, customer contact, return on investment or business outcomes.

10. Advertising Reports, Listing Reports and Analytics

Send N Share™ may provide reports, dashboards, summaries or analytics relating to advertising, listings, views, clicks, impressions, enquiries or account activity.

Reports are provided for general business information and convenience. They may be based on available system data, third-party data, server logs, campaign settings or platform activity.

Reports may be delayed, incomplete, estimated, filtered, rounded, affected by spam protection, affected by third-party systems or affected by technical limitations. Reports should not be treated as audited financial records.

11. Partners, Resellers and Trade Accounts

Send N Share™ may work with authorised partners, global partners, resellers, trade accounts, designers, sales representatives or service providers who promote, sell, design or assist with Send N Share™ services.

Pricing may vary depending on location, setup requirements, custom design work, support needs, reseller arrangements, promotions, currency, taxes or agreed service scope.

If you purchase through a third-party reseller, partner or service provider, your payment, refund, support and service arrangements may also be subject to that third party’s own terms, unless otherwise agreed in writing by Send N Share™.

Trade accounts may be billed on the 1st or 15th of each month or according to the billing cycle agreed with Send N Share™.

12. Payments, Billing and Invoicing

Payments may be processed through PayPal, Stripe, bank transfer, invoice, dashboard checkout or another approved payment method. Third-party payment processors may apply their own terms, fees, processing times and security requirements.

Prices may be shown in Australian dollars or another stated currency. Prices may change from time to time. Any applicable taxes, payment processing fees, administration fees or custom service fees may be added where permitted and disclosed.

Invoices may be issued for active services, memberships, mobile websites, advertising, custom work, partner services or account activity. Unless otherwise agreed in writing, invoices must be paid by the due date stated on the invoice.

If payment is overdue, we may suspend, restrict or remove access to dashboard features, mobile websites, paid listings, advertising, reports or other paid Services until outstanding amounts are paid.

13. Refund Policy

We offer a 10-day refund request period for eligible purchases, subject to review, approval and any applicable administration, setup or processing fees.

Refund requests must be made within 10 days of purchase and must include a valid reason. Where approved, refunds will generally be issued to the original payment method.

Unless required by law or agreed in writing, refunds may not be available for completed setup work, custom design work, advertising that has commenced, dashboard accounts where full access has been used, third-party reseller purchases, non-recoverable payment fees, or services cancelled due to breach of these Terms.

14. Suspension, Deactivation and Termination

We may suspend, restrict, deactivate or terminate an account, listing, mobile website, advertisement, report access or other Service if payment is overdue, you breach these Terms, your Content is unlawful or misleading, your account is used for spam, fraud or harmful activity, or we are required to act by law, regulator, payment processor or third-party service provider.

Where possible, we may provide notice before suspension or deactivation, but we are not required to do so where urgent action is needed to protect users, the platform, third parties or Send N Share™.

15. Prohibited Use

You must not use the Services to create, promote, advertise, sell, link to or distribute Content that is false, misleading, fraudulent, infringing, malicious, unlawful, offensive, unsafe, harmful, spam-like or damaging to the operation, security, reputation or integrity of Send N Share™ or other users.

You must not interfere with the platform, attempt unauthorised access, upload harmful code, misuse user information, impersonate another person or business, or misrepresent your qualifications, licences, products, services or authority.

16. Intellectual Property and Trademark

The Send N Share™ name, brand, logo, design elements, platform layout, software, website content, graphics, text, icons and related materials are owned by or licensed to Send N Share™ and are protected by intellectual property laws.

You must not copy, reproduce, modify, sell, reverse engineer, misuse or exploit any part of the Services except as permitted through your authorised use of the platform.

17. Privacy, Cookies and Third-Party Services

Your use of the Services is also governed by our Privacy Policy. We may use cookies, pixels, analytics tools and similar technologies to improve functionality, performance, security, advertising, reporting and user experience.

The Services may connect to or rely on third-party services, including payment processors, maps, analytics, hosting, advertising tools, messaging platforms, social media, embedded content and external links. We are not responsible for third-party websites, policies, outages, fees or actions.

18. Disclaimers

To the maximum extent permitted by law, the Services are provided on an as is and as available basis. We do not guarantee that the Services will be uninterrupted, error-free, secure, free from viruses, compatible with every device, or available at all times.

We do not guarantee business results, sales, leads, enquiries, conversions, clicks, traffic, search ranking, advertising performance, customer engagement or profitability from using the Services.

Any information displayed in listings, mobile websites, advertisements or user Content is supplied by users or third parties. We may moderate or review Content, but we do not guarantee the accuracy, reliability, legality or completeness of all user-submitted information.

19. Limitation of Liability and Indemnity

To the maximum extent permitted by law, Send N Share™ excludes liability for indirect, incidental, special, consequential or economic loss, including loss of profits, loss of revenue, loss of data, loss of goodwill, loss of opportunity or business interruption arising from or related to your use of the Services.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot legally be excluded, restricted or modified.

You agree to indemnify Send N Share™ against claims, losses, liabilities, costs, expenses or damages arising from your breach of these Terms, your Content, your advertising, your mobile website, your misuse of the Services, your infringement of third-party rights or your unlawful conduct.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with the updated date. Where changes are significant, we may provide notice by email, dashboard notice, website notice or another reasonable method.

Your continued use of the Services after the updated Terms are posted means you accept the updated Terms.

21. Governing Law

These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland, Australia and any courts entitled to hear appeals from those courts.
